Government of the Republic of Zambia
ZAMBIA is a Constitutional Democratic State with the EXECUTIVE, LEGISLATURE and the JUDICIARY operating as separate organs of Government.
The PRESIDENT is the Head of the EXECUTIVE and also the Commander-in-Chief of the Armed and Defence Forces. The Vice President is under the Amended 2016 Constitution a “Running Mate” to the Republican President in a General Election and therefore enjoys “security of tenure” which runs concurrently with the Republican President. The President is under the Constitution, allowed to appoint a prescribed number of Members of Parliament as Ministers of State. The current President of the Republic is HIS EXCELLENCY, MR. EDGAR CHAGWA LUNGU. The Vice President is HER HONOUR MRS. INONGE MUTUKWA WINA.
The LEGISLATURE of the Republic of Zambia consists of the Republican President, the Speaker and the Members of Parliament. The Speaker of the National Assembly is elected by Members of Parliament on recommendation by the President and political parties holding seats in the National Assembly.
The JUDICIARY, of the Republic of Zambia consists of the Chief Justice, Deputy Chief Justice (Supreme Court), the President of the Constitutional Court and Deputy President of the Constitutional Court (Constitutional Court). Under Article 121 of the Constitution, the Supreme Court and Constitutional Court rank equivalently (“pari pasu”).
In other words, the Zambian Judiciary consists of the Superior Courts consisting of the Supreme Court, the Constitutional Court, the Court of Appeal and the High Court) and Lower Courts consisting of subordinate courts, the small claims courts, the local courts; and other courts, as prescribed.
